1. Acceptance of Terms
By downloading, installing, or using the ClaimMiles mobile application, you agree to be bound by these Terms of Use. If you do not agree, do not use the app.
We may update these Terms from time to time. Continued use of the app after changes are posted constitutes acceptance of the revised Terms.
2. Description of Service
ClaimMiles is a mileage tracking and reporting application that lets users log, categorize, and export vehicle trips for personal, business, tax, or reimbursement purposes. The app provides tools to track distance using GPS or manual entry, generate mileage reports, and manage vehicle and trip records.
3. Account Registration
You may need to create an account to use some or all app features. You agree to provide accurate information, keep it up to date, and maintain the confidentiality of your login credentials.
You must be at least 13 years old, or older if required by applicable law in your jurisdiction, to create an account and use the app.
4. Subscriptions and Payments
The app may offer Free, Pro, Premium, or other plans. Features available under each plan are described within the app and may change over time.
Subscriptions are purchased through the platform where you downloaded the app. Purchases are subject to that platform’s billing terms. We do not directly process payments or store full card details.
Where applicable, subscriptions auto-renew unless canceled before renewal. Refunds are governed by applicable law or platform rules. Restore Purchases may be available within the app, subject to platform availability.
5. Acceptable Use
You agree not to:
- Use the app for unlawful purposes
- Attempt unauthorized access to the app or its infrastructure
- Reverse engineer the app except where permitted by law
- Use bots or automated scripts
- Submit fraudulent trip data
- Interfere with the app’s infrastructure or other users
6. Mileage, Tax, and Financial Disclaimer
ClaimMiles is not a tax advisory service. Mileage calculations are estimates based on GPS data, manual entry, device settings, and user input. Accuracy may vary and results may not be exact.
Any mileage rates, tax estimates, or reimbursement calculations shown in the app are for informational convenience only. You are responsible for confirming current requirements with relevant authorities or qualified professionals.
Reports generated by the app are convenience tools and do not constitute tax, legal, accounting, or financial advice.
7. Location and GPS
The app may use device location services to track routes and calculate distances when GPS or location-based features are enabled. GPS accuracy depends on device hardware, settings, signal availability, and environmental conditions.
You are responsible for ensuring location permissions are correctly configured on your device.
8. Your Data
You retain ownership of the trip data, vehicle records, and other content you enter into the app. By using the app, you grant us a limited license to host, store, process, display, and use your data solely as necessary to operate, maintain, improve, and provide the app’s features to you.
We do not claim ownership of your data and do not use trip data for advertising.
9. Intellectual Property
The app, including its design, software, text, graphics, branding, logos, and features, is owned by AUSV Systems or its licensors and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for its intended mileage tracking purposes.
10. Availability and Changes
We do not guarantee that the app will always be available, uninterrupted, secure, or error-free. We may suspend, modify, discontinue, or update the app or any feature at any time, with or without notice.
11. Disclaimers and Limitation of Liability
To the maximum extent permitted by applicable law, the app is provided on an “as is” and “as available” basis without warranties of any kind. We do not warrant that the app will be error-free, uninterrupted, or suitable for your specific tax, legal, business, or compliance requirements.
To the maximum extent permitted by law, AUSV Systems is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, business interruption, tax penalties, or other intangible losses arising out of or related to your use of the app.
12. Termination, Governing Law, and Contact
You may stop using the app at any time and may request account deletion in accordance with the app’s settings and Privacy Policy. We may suspend or terminate access if you violate these Terms or create risk or liability for us or others.
These Terms are governed by the laws of Victoria, Australia, unless applicable consumer law provides otherwise.
